Current

No backlog for India in this category as of September 2026. Any priority date qualifies. The September 2026 bulletin lists this row as current for every chargeability area.

USCIS designated the Final Action Dates chart for employment-based adjustment-of-status filings in September 2026. That designation changes month to month, and it determines which cutoff actually governs when you can file.

How fast the line is moving

Note: this category is current (no backlog) for India. In each of the last 24 bulletins it was current for India on both the Final Action chart and the Dates for Filing chart, so there is no cutoff date to measure a pace against.

Has it moved backward?

Not in the last 24 bulletins. From October 2024 through September 2026 the row stayed current for India. The row first appeared in the May 2022 bulletin. Months before October 2024 are not in the table below.

The table above is the last 24 bulletins. The cutoff was current in every row. The chart column is the employment chart USCIS designated that month, the same designation recorded on the other employment pages. The set-aside rows began in May 2022, 53 monthly bulletins through September 2026.

Who is in this line

This line is the infrastructure set-aside: 2 percent of EB-5 visas, for investors in a qualifying infrastructure project. The bulletin category is RI. It is not the unreserved row. In September 2026 this row is current for every country of birth, including India. The Indian community guides show where people born in India have settled in the U.S.

What a priority date actually is

Your priority date is the day USCIS accepted the investor petition, Form I-526 or I-526E. It is your place in line, and it never changes.

Every month the State Department publishes a cutoff date for each category and country of birth. A visa number is available only under the Final Action chart, and only when the priority date is earlier than that cutoff. A Dates for Filing cutoff controls filing, not visa issuance. Because the law caps how many green cards any one country can receive per year, applicants born in high-demand countries wait far longer than the worldwide line for the exact same category.

Country of birth is what matters, not citizenship and not where you live now. Two investors in this same set-aside can be in different lines if they were born in different countries.

This page is information, not legal advice. It reports published government data and nothing more. Cutoff dates move unpredictably and individual cases turn on facts this page cannot know. For advice about your situation, consult a licensed immigration attorney.
